What this policy covers

This policy covers bennydata.com, our early access and sign-up forms, our emails, and Ask Benny, the Form 5500 research tool you use inside your own AI assistant through the Benny Data MCP connection. Together we call these the "Service."

This policy does not cover the AI platform you connect to Benny, such as Claude, Grok, ChatGPT, Copilot, or Gemini. Those companies have their own privacy policies. It also does not cover other websites we link to.

Information you give us

You may give us information when you:

  • Join the early access list or claim an offer. Our forms ask for your first and last name and work email. They may also ask for your company, your role, what you would ask Benny first, and your consent to receive emails from us.
  • Create or upgrade an account. We keep your account details, your plan, and records of your subscription and any contract with us.
  • Pay for a plan. Payments are handled by our third-party payment processor. Benny Data does not store your card numbers or other payment details, and they are not stored through your AI platform. We receive only limited information, such as your billing name, billing contact, and payment status.
  • Contact us. If you email us or ask Benny a support or billing question, we keep the message and our reply.

Information we collect when you use Ask Benny

When you ask Benny a question inside your AI assistant, your AI platform sends a request to Benny Data. That request usually includes your question, or a version of it written by your AI assistant. We use it to search Form 5500 data and send back an answer with citations.

We also record related activity, such as the time of each request, which account made it, how many searches you have used, and any errors. This helps us count searches toward your plan, provide support, and keep the Service working.

Benny Data connects only with your AI platform. It does not connect directly with any other third-party apps. If you choose to connect other apps to your AI platform, those apps may interact with, connect to, and share data with the Service. Connecting other apps is your choice, and you do so at your own responsibility and risk.

We may use the questions you send through Ask Benny to help develop future outputs and improve how we segment data, so that we can provide better results and a better overall user experience. Questions used for this purpose are selected anonymously and at random from a pool of similar requests made by multiple users asking for the same data output.

Information we collect automatically

When you visit our website or open our emails, we and our service providers may collect:

  • Your IP address and a general location based on it
  • Your browser, device type, and operating system
  • The pages you view, the links you click, and the time you spend on them
  • The website, social media post, or email that sent you to us, including campaign tags (such as UTM tags) in the link
  • Whether you opened an email or clicked a link in it

We collect this through cookies, tracked links, server logs, and similar tools. See "Cookies and analytics" below.

Information in Form 5500 filings

Benny's research data comes from Form 5500 filings. Employee benefit plans file these reports with the U.S. Department of Labor, and the government makes them public. Some filings name people, such as plan administrators, people who signed the filing, or service provider contacts.

Benny reports what was filed. We do not edit the filings, and they may contain errors made by the filer. If you see a mistake about yourself, the fix usually has to come from the plan that filed the report. You can still contact us, and we will review your request under the law that applies to you.

Benny Data does not enhance or add to the information that is publicly available in Form 5500 filings. You may choose to enhance or add to Benny's results yourself or through third-party providers, such as data brokers. If you do, you are solely responsible for doing so.

Cookies and analytics

Cookies are small files that a website stores in your browser. We and our service providers may use cookies and similar tools to:

  • Keep forms and pages working
  • Remember your settings
  • Measure visits, traffic sources, and which pages people use
  • See how our emails and social media posts perform

The tools we currently use are:

  • Cookies and similar tools needed to run the site. These keep our pages and forms working.
  • Google Analytics. Google Analytics (GA4) helps us understand how visitors find and use our website, such as which pages they view and where their visit came from. Google processes this information as our analytics provider.
  • Link and click tracking. Links in our social media posts and emails may include campaign tags (such as UTM tags), and our email and CRM provider, HighLevel, tracks clicks on links in our emails. This shows us which posts and emails people respond to.

Most browsers let you block or delete cookies. If you block them, some parts of the site, such as our forms, may not work as expected.

No advertising or retargeting tools. We do not currently use advertising or retargeting pixels, and we do not engage in targeted advertising. If we begin using third-party advertising or retargeting tools that would count as "selling" or "sharing" personal information, or as "targeted advertising," under applicable state law, we will first update this policy. We will also provide a clear "Do Not Sell or Share My Personal Information" link, or a similar way to opt out of targeted advertising, and we will honor opt-out preference signals such as Global Privacy Control (GPC).

Do Not Track and Global Privacy Control. Some browsers send a "Do Not Track" signal. There is no common standard for it, so our site does not respond to it. Some browsers and extensions also send a Global Privacy Control (GPC) signal, which asks websites not to sell or share your personal information. We do not sell or share personal information or use it for targeted advertising, so there is currently nothing to opt out of. If that changes, we will treat a GPC signal as a valid request to opt out, as described above.

Who we share information with

We share personal information only as described here:

  • Service providers. These companies help us run our business. They include HighLevel (also known as LeadConnector), which provides our website, forms, customer records (CRM), and email tools. They also include Google, which provides our website analytics (Google Analytics), and providers of hosting, data storage, payments, and customer support. They may use your information only to provide services to us.
  • Your AI platform. When you use Ask Benny, our answers go back to the AI platform you chose. Benny Data does not send data directly to other third-party apps. If you connect other apps to your AI platform, they may receive data from Benny through it, at your own responsibility and risk. Those companies handle the data under their own policies.
  • Legal reasons. We may share information if the law requires it, or if we believe it is needed to protect the rights, safety, or property of our users, the public, or Benny Data.
  • Business changes. If Benny Data is involved in a merger, sale, financing, or similar deal, personal information may be transferred as part of that deal. This policy would still protect it unless you are told otherwise.
  • With your consent. We may share information in other ways if you ask us to or agree to it.

We do not sell your personal information. We do not share it for cross-context behavioral advertising, as California law defines that term, and we do not use it for targeted advertising. We do not intentionally sell any data obtained through our website or user accounts. We have not sold or shared personal information in the past 12 months.

How long we keep information

We keep personal information only as long as we need it for the reasons in this policy, including to provide the Service, meet our contracts, resolve disputes, and follow the law. Then we delete it or remove details that identify you.

  • Early access list entries: Everyone who requests early access is given a Free plan account, so early access entries become account records and are kept as described below.
  • Account and billing records: After an account closes, account and billing records are kept by our third-party platform provider, which follows applicable federal, state, and local record-keeping requirements.
  • Ask Benny request and usage logs: Typically deleted after 14 to 30 days, depending on request volume and memory limits.

How we protect information

We use reasonable safeguards to protect personal information. These include encrypted connections, limits on who can access data, and security settings offered by our providers. Benny Data does not operate its own apps or websites that store your information, and Ask Benny is accessible only through an MCP (Model Context Protocol) connection with your AI platform. No system is perfectly secure, so we cannot promise that information will never be lost or misused. If you think your account is at risk, email us right away.

Your choices

  • Marketing emails. Click "unsubscribe" in any marketing email, or email us. We will still send messages about your account, billing, and the Service.
  • Cookies. Use your browser settings to block or delete cookies.
  • Account details. Email us to update your name, email, or company.

Your privacy rights

Depending on where you live, you may have the right to:

  • Know and access the personal information we have about you, including the categories of information, where it came from, why we use it, and the kinds of recipients we disclose it to
  • Get a copy of your personal information in a portable format
  • Correct information that is wrong
  • Delete your personal information
  • Opt out of the sale or sharing of your personal information, targeted advertising, and profiling that leads to decisions with legal or similarly significant effects (we do not do any of these)
  • Limit the use of sensitive personal information (we do not ask for it)
  • Not be discriminated against for using these rights

These rights come from laws such as the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), and similar laws in states such as Colorado, Connecticut, Virginia, Utah, Texas, and Oregon. Some laws have exceptions, including for public government records and business contact information.

How to make a request. Email [email protected] with the subject line "Privacy request." Tell us what you want us to do. We will confirm your identity before we act, usually by asking you to reply from the email address on file. We aim to respond within 45 days, or sooner if the law requires. If we need more time, as some laws allow, we will tell you why and how much longer we need.

Authorized agents. You may have someone, such as an authorized agent, make a request for you. We may ask for signed proof that you gave them permission, and we may still need to confirm your identity directly with you.

Appeals. If we deny your request, in whole or in part, you can appeal by replying to our decision or emailing us with the subject line "Privacy appeal." We will respond to your appeal within the time required by the law that applies to you. We will tell you the result and, if your appeal is denied, how to contact your state attorney general.

No discrimination. We will not treat you differently, charge you a different price, or give you a lower level of service because you used your privacy rights.

California details. In the past 12 months, we collected these categories of personal information: identifiers (such as name, email, and IP address), commercial information (such as plan and purchase records), internet activity (such as pages viewed and Ask Benny requests), professional information (such as company and role), and general location from your IP address. We collected them from the sources and for the purposes described in this policy, and we disclosed them for business purposes to the kinds of recipients listed in "Who we share information with." We keep each category for the periods described in "How long we keep information." We do not collect sensitive personal information. In the past 12 months, we have not sold personal information or shared it for cross-context behavioral advertising, and we have no actual knowledge of selling or sharing the personal information of anyone under 16. You can use your California rights, including the rights to know, delete, correct, and opt out, as described in "How to make a request" above.

Children

The Service is for business professionals. It is not meant for anyone under 18, and we do not knowingly collect personal information from children. If you believe a child has given us information, email us and we will delete it.

Where we process information

Benny Data is based in the United States, and we process information in the United States. Benny Data does not store data outside the United States. However, our third-party payment and platform providers, such as HighLevel and Stripe, may store or process data outside the United States. If you use the Service from another country, your information will be moved to and handled in the United States, where privacy laws may differ from those in your country.

Changes to this policy

We may update this policy from time to time. When we do, we will change the "Last updated" date at the top. If we make an important change, we will also tell you by email or with a notice on our website before it takes effect.
