1. What Benny Data does

Benny Data is a research tool for U.S. Form 5500 retirement and benefit plan data. You connect the Benny Data MCP to an AI platform you already use, such as Claude, Grok, ChatGPT, Copilot, or Gemini. Then you can ask questions in plain English through "Ask Benny" and get answers that cite the Form 5500 filings they come from. You can also ask Benny support and billing questions.

2. Who may use the Service

The Service is for business and professional use. To use it, you must be at least 18 years old and able to enter into a binding contract.

If you use the Service for a company or other organization, you confirm that you have authority to accept these Terms for it. In that case, "you" also means that organization.

3. Your account

  • Give us accurate information and keep it up to date.
  • Keep your login details and any access keys private. Each account is for one user and for individual use only. Do not share your login details or access keys with anyone else.
  • You are responsible for everything that happens under your account, including requests your connected AI assistant sends to us.
  • Tell us right away at [email protected] if you think someone has used your account without permission.

4. Early access and onboarding

Before full launch, you can join our early registration list through the forms on our website.

  • Everyone who requests early access is given a Free plan account.
  • We onboard people from the list in the order they joined, on a first-come, first-served basis.
  • Joining the list does not guarantee access by a certain date.
  • When your account is ready, we will email you instructions to get started.
  • If you claimed the Exclusive Offer, you will pay when you become eligible and we email you. You do not need a credit card to claim the offer, and claiming it does not charge you.

Early access features may change, be limited, or be removed while we improve the Service.

5. Plans and prices

We offer these plans. All prices are in U.S. dollars.

  • Free. $0. Includes 15 Form 5500 searches per month. You only need your name and email to sign up.
  • Exclusive Offer: Current + Previous Years Data. $599 per year (regularly $999). Includes current year (2025) Form 5500 data plus all previous years available on the plan (2023 and 2024). This is a limited-time offer that ends 11/30/26. If you claim it by then, your price stays at $599 per year for the life of your subscription. "Life of your subscription" means for as long as your subscription stays active without a break. If your subscription is canceled or lapses, the $599 price no longer applies.
  • Annual Renewal Plan. $699 per year. Includes current year Form 5500 data.
  • Future offers. Future offers may come with their own terms and conditions that are not included in the general offer terms above. If so, those terms will be listed in Section 23, "Additional offer terms," at the bottom of these Terms.

All plans include real-time access to Form 5500 data updates as they become available, at no extra fee. Renewing a plan never takes away access to data you already have.

We may change prices or plans in the future. Any price change will not affect the Exclusive Offer price lock described above. For other paid plans, we will tell you about a price change before it applies to your next renewal.

6. Billing and automatic renewal

Paid plans renew automatically. Paid plans are billed once a year, in advance, in U.S. dollars. Each plan renews automatically for another year at the end of each yearly term, and we charge the payment method on file at that time unless you cancel.

How to cancel. To avoid automatic renewal, you must cancel through your account at least 3 days before your next automatic renewal billing date. If you cancel in time, your plan stays active until the end of the year you already paid for, and then it does not renew.

Renewal reminders. Based on your notification preferences, we will send you reminders 30, 14, and 3 days before your plan renews automatically. Each reminder gives you the chance to opt out of automatic renewal by canceling.

Payments. Payments are processed by our third-party payment processor. You authorize us and our payment processor to charge the payment method you provide for your plan and each renewal.

Taxes. Prices do not include taxes unless we say so. Our third-party payment processor applies any taxes at checkout, based on your location and applicable state and local sales tax requirements. You are responsible for any sales, use, or similar taxes that apply.

7. Cancellations, billing disputes, and refunds

Benny Data subscriptions are standard business-to-business (B2B) licensing agreements governed by these Terms. To sign up for an account on bennydata.com, on any plan, you must agree to these Terms. These Terms may change with or without written notice, as described in Section 21. We handle cancellations, billing disputes, and any refunds directly with you, case by case.

Cancellations. To avoid being charged for the next term, you must cancel at least 3 days before your next automatic renewal billing date. See Section 6 for how cancellation works.

Billing disputes. If you have a billing question or think a charge is wrong, email [email protected]. Please contact us before you dispute a charge with your bank or card company, so we can try to fix it quickly.

Refunds. We review refund requests case by case. We consider factors such as how much time has passed since your purchase or renewal, the data you accessed, and your usage of the Service. Benny Data, LLC makes the final decision to deny a refund, issue a full refund, or grant a partial refund. Granting a refund in any case does not create a refund policy or an obligation to grant refunds in the future.

Which terms control. These Terms govern your account and subscription. If you also sign an order form or other written contract with us and it conflicts with these Terms, these Terms control.

8. Your license to use the Service

While your account is active and you follow these Terms, we give you a limited, non-exclusive, non-transferable right to use the Service and its results for your own internal business purposes. Results are for internal use within your company only. You may not share, publish, or distribute results, in whole or in part, to anyone outside your company, including clients.

10. Form 5500 data and AI answers

Where the data comes from. Benny's data comes from public Form 5500 filings that benefit plans submit to the U.S. Department of Labor. Benny reports what was filed. Filings may contain errors, omissions, or out-of-date information from the filer, and we do not correct them.

AI answers can be wrong. Answers are produced with the help of AI. They can misread a question, leave something out, or summarize a filing incorrectly. Each answer cites the filing it relies on, so check important facts against the cited filing before you rely on them.

Not advice. The Service gives general information only. It is not legal, tax, accounting, or investment advice, and it does not replace advice from a qualified professional.

No government connection. Not affiliated with the U.S. Department of Labor. Form 5500 data is public government information. We do not claim to own the underlying filings.

11. Your AI platform and other services

To use Ask Benny, you connect it to an AI platform run by another company, such as Claude, Grok, ChatGPT, Copilot, or Gemini. Benny Data connects only with your AI platform, not directly with other apps. If you connect other apps, such as a CRM, to your AI platform, those apps may interact with, connect to, and share data with the Service. You do so at your own responsibility and risk, and any results those apps receive remain subject to Section 8. Those services are not run by us. Their own terms and privacy policies apply, and we are not responsible for how they work, what they cost, or what they do with your data. Product names and trademarks belong to their owners.

12. Your information and feedback

You own the questions and information you send to the Service. You give us permission to use them to provide, support, and protect the Service, as described in our Privacy Policy.

If you send us ideas or feedback, we may use them freely without paying you or owing you anything.

13. Our rights

Benny Data and our licensors own the Service, including the software, the way data is organized and presented, and the Benny Data and Ask Benny names and logos. These Terms do not give you any ownership rights. Anything not expressly allowed in these Terms is reserved by us.

14. Privacy

Our Privacy Policy explains how we collect, use, and share personal information. It is part of these Terms.

15. Suspension and ending your access

You may stop using the Service at any time. To stop automatic renewal of a paid plan, follow Section 6.

We may suspend or end your access if you break these Terms, fail to pay, create a security or legal risk, or if we stop offering the Service. Where it is reasonable, we will tell you first and give you a chance to fix the problem.

Sections that should logically continue after your access ends will continue. These include Sections 7, 10, and 12 through 20.

17. Limits on our liability

TO THE FULLEST EXTENT THE LAW ALLOWS:

  • OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT BE MORE THAN THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR $100 IF YOU PAID NOTHING.

Some places do not allow these limits, so they may not fully apply to you.

19. Governing law and disputes

These Terms are governed by the laws of the State of Utah, without regard to its conflict of laws rules.

Before filing any claim, please email [email protected] and describe the problem. Both sides will try in good faith to resolve it within 30 days.

Binding arbitration. If the dispute is not resolved informally, you and Benny Data agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by final and binding arbitration on an individual basis, except as described below. The arbitration will be administered by the American Arbitration Association (AAA) under its applicable rules, including its Consumer Arbitration Rules where they apply, or by a similar arbitration provider under similar rules. The arbitration will be seated in Utah County, Utah. A court with jurisdiction may enter judgment on the arbitrator's award.

Class action waiver. You and Benny Data may bring claims against each other only on an individual basis, and not as a plaintiff or class member in any class, collective, consolidated, or representative action or arbitration. The arbitrator may not combine more than one person's claims and may not preside over any class or representative proceeding.

Jury trial waiver. You and Benny Data each give up the right to a trial by jury for any dispute covered by these Terms.

Exceptions. Either side may bring an individual claim in small claims court if the claim qualifies. Either side may also ask a court for injunctive relief to protect its intellectual property rights.

Courts. Any lawsuit for a small claims matter, for injunctive relief to protect intellectual property, or if this arbitration agreement is found unenforceable, must be brought only in the state or federal courts located in Utah County, Utah, and both sides agree to those courts' jurisdiction.
